Please read these Terms carefully and make sure that you fully understand all the contents.
1. OVERVIEW
These Terms of Service (“Terms”) are entered into by and between you and BetHog Operations Ltd. ("BetHog"), and is made effective as of the date of your using, visiting and/or accessing any part the BetHog platform by way of this website (“Site”) and/or utilizing any services accessed through the Site or any other ways made available by BetHog (“Services”), as applicable, or the date of electronic acceptance of the Terms.
The terms “we”, “us” or “our” will refer to BetHog. The terms “you”, “your”, “User” or “customer” will refer to any individual or entity who accepts this Agreement.
2. ACCEPTANCE OF THE TERMS
By accessing or utilizing the Site or any Services, you agree to be bound by (i) these Terms; (ii) our Privacy Notice and (iii) our Sportsbook Rules applicable to specific Services (together, the ‘Agreement’). If there is a conflict between the Terms and any of the specific Sportsbook Rules, then the terms of these Terms will prevail.
3. MODIFICATION OF AGREEMENT, SITE OR SERVICES
BetHog reserves the right to change any part of the Agreement from time to time and all changes will be published on the Site. Your use of this Site or the Services after such changes or modifications have been made will constitute your acceptance of this Agreement as last revised. When a material change of the Agreement is carried out, we will take appropriate steps to bring those changes to your attention (e.g. by email, notification at login, or otherwise). Your continued use of the Site or the Services after this date will constitute your acceptance of this Agreement as revised. In the event that you do not wish to continue using the Services, you can close your Account at any time.
BetHog may also, in its discretion, without any prior notice and without liability, a) modify, suspend or discontinue any portion of the Site or Services, including any Terms, and b) remove or change any content or functionality from the Site or Services. BetHog furthermore reserves the right to take any action related to the Site or Services as required to comply with applicable law.
4. ELIGIBILITY
The Services may only be used by persons who have reached at least the age of 18 (older in some jurisdictions, as noted at the time of registration). By making use of the Services, you confirm that you are of applicable legal age and legally capable at the time of concluding a binding legal agreement with BetHog. BetHog reserves the right to ask for proof of age from any customer and suspend their account until satisfactory documentation is provided. The Services may only be used by persons who are resident in a jurisdiction where the use of the Services is not prohibited (please see our list of Prohibited Jurisdictions, attached and incorporated to these Terms as Appendix 2, for more information).Before you make use of the Services, it is your responsibility to verify the laws on gambling which govern your place of residence and any location where you engage with the Site or Services, and to act in accordance with any restrictions. By utilizing the Services, you warrant that you have the legal right to make use of the Services and that such use is not prohibited by any law.
5. ACCOUNT CREATE, VERIFICATION AND DUE DILIGENCE
In order to access (most) features of this Site, and/or to utilize the Services, you must first create an account (“Account”). The terms governing the restrictions, requirements and obligations for your Account are contained throughout this Agreement, but most specifically are set forth in the Account Creation and Registration Agreement, attached and incorporated as part of these Terms as Appendix 1.
You represent and warrant to BetHog that all information you submit when you create your Account is accurate, current and complete, and that you will keep your Account information accurate, current and complete, and you represent and warrant that you have all legal right and authority to enter into an account with BetHog, which includes the lawful and legal right to any crypto wallets that are linked to your Account. If BetHog has reason to believe that your Account information is untrue, inaccurate, out-of-date or incomplete, BetHog reserves the right, in its sole and absolute discretion, to suspend or terminate your Account, and any wagers may be voided. You are solely responsible for the activity that occurs on your Account, whether authorized by you or not, and you must keep your Account information and credential secure.
We reserve the right to close or limit your account if we suspect that the account is using a temporary or throwaway mail service for registration or that the email address used is an alias for a centralized mailbox. We expect all users to have access to their emails and if in doubt, we may ask users for identification via email.
You must notify BetHog immediately of any breach of security or unauthorized use of your Account. BetHog will not be liable for any loss you incur due to any unauthorized use of your Account. You, however, may be liable for any loss BetHog or others incur caused by your Account, whether caused by you, or by an authorized person, or by an unauthorized person. Should you lose your account details or believe that someone else may have your account details, we recommend that you reset your password immediately and contact us by sending an email to Support@BetHog.com.
6. ACCOUNT TERMINATION AND CLOSURE
BetHog may at any time, with or without notice, without liability, and for any reason deny you access to the Site and Services, and terminate or suspend your Account. In any event, the Agreement will nevertheless continue to apply in respect of your use of the Site and Services prior to termination or suspension. We may suspend or terminate your use of the Services and your Account immediately without notice if:
● For any reason we decide to discontinue to provide the Services;
● We believe that you have breached any of the Agreement;
● We believe that you have acted inappropriately in any way in your use of the Services and/or the Site;
● Your account is associated in any way with any existing account that has been terminated for breach of the Agreement;
● We suspect that in using the Services, you are acting fraudulently, or are involved in collusion, money laundering activities and/or other forms of criminal activity; and
● For any other reasonable grounds we see fit.
You may close your Account at any time by sending an email to us at Support@BetHog.com. Closure will occur within seven (7) calendar days after receipt by BetHog of your email, but you will remain responsible for any activity on your Account between our receipt of your email and closure of your Account by BetHog.
7. OWNERSHIP AND INTELLECTUAL PROPERTY
BetHog grants to you a revocable, personal, limited, non-sublicensable, non-transferable, and non-exclusive license to access and use the Site, as permitted under the Agreement, subject to and conditional on your continued compliance with all terms of the Agreement. All rights, title and interest, including all intellectual property rights, in the Site, including content and BetHog trademarks therein, are and will remain the property of BetHog. Without limiting the generality of the foregoing, nothing contained in the Agreement, these Terms or on the Site or Services should be construed as granting, by implication, estoppel, or otherwise, any license or permission or other right to use any content or BetHog trademark. Unauthorized use of any Site content or BetHog trademark is strictly prohibited. Nothing in these Terms should be construed as granting any right to use the Site for a commercial or other non-personal purpose.
8. USING THE SERVICES
You must abide by any and all Terms in making use of the Services as herein set out. By utilizing the Services, you acknowledge and agree that:
● You are only allowed to have one active Account with BetHog; should we identify you have more than one account, in violation of these Terms and the Agreement, we reserve the right to treat any such accounts as one joint account;
● All wagers and bets are accepted at the sole and absolute discretion of BetHog;
● All withdrawals, payouts and winnings are determined and issued at the sole and absolute discretion of BetHog, including any payouts or winnings arising from contests and competitions hosted by BetHog
● You must not treat BetHog as a financial institution, and you will not receive any interest from BetHog on the funds in your self-custodial wallet;
● It is unlawful to make use of the Services with funds which consist of the proceeds of criminal activities;
● Player collusion is expressly prohibited;
● Any applicable taxes and fees in connection with any winnings are your sole responsibility.
● All wagers with the BetHog sportsbook product shall be subject to the terms found in Live Sports Betting Rules and Prematch Sports Betting Rules (collectively the “Sportsbook Rules”) located in our Help Center.
You assume all risk, and BetHog disclaims any responsibility or liability to you or any third party, for price fluctuations in fiat or digital currency from any interactions with BetHog's online Site and Services. BetHog will not bear any responsibility whatsoever for mistakes made during data inputting, transfer or assessment. BetHog reserves the right to correct obvious mistakes, especially those made during inputting odds and/or bet results and will be entitled to invalidate such bets. BetHog additionally disclaims any responsibility associated with correctness, exhaustiveness and relevance of information services. BetHog also disclaims any responsibility whatsoever related to correctness of current information, statistics and intermittent results of live bets. In any case described herein above, you will be reimbursed for the amount wagered.
You fully accept that all computer instructions and responses sent to you from BetHog’s online Site and Services will be binding on you. You undertake to promptly notify BetHog in writing of any error or incompleteness in BetHog’s Site or Services. BetHog will be entitled to hold you liable for any damages incurred if you deliberately or fraudulently use any technical or administrative malfunction or error to place any winning bet. Notwithstanding any other provisions of the Agreement respecting liability, BetHog will not be liable for any claims for damages/ reimbursement (in particular, claims related to system errors, defects, delays, manipulations or wrongful transfer of data), unless such claims regard gross negligence, and, in any event, BetHog’s liability in such case will be strictly limited to the lesser of bet or winnings amount.
9. DEPOSITS AND WITHDRAWALS; WAGER THRESHOLDS AND LIMITS; BONUS FUNDS
Deposits and Withdrawals
To deposit funds into your Account, you may transfer funds from a cryptocurrency wallet under your control or via any of the other payment methods that may be available from time to time on the Site. Deposits may only be made with your own funds. You may not deposit funds which originate from criminal or other unauthorized activity. BetHog takes no responsibility for any delays to deposits which may arise from or be associated with blockchain transaction times or the use of particular payment methods or which may be caused by any third party. BetHog reserves the right to use additional procedures and means to verify your identity when processing deposits into your Account. Please note that the use of some payment methods may involve additional fees, and your bank or payment service provider may also charge you additional fees for making transfers or converting currencies. BetHog may refuse to credit any deposits at our own discretion. If your Account has been blocked or suspended, you must refrain from attempting to deposit funds into it. Should you attempt to deposit funds when your Account is blocked or suspended, (i) you acknowledge and accept the risk that such deposited funds may be permanently lost, and (ii) if those deposited funds are not lost, we will have the right to retain them.
Cryptocurrency withdrawals will be made to your stated cryptocurrency wallet address after you make a valid withdrawal request. Withdrawals may be restricted if we detect suspicious, unauthorized or illegal activity relating to your Account. If we mistakenly credit your Account with winnings or any other sums that do not belong to you, whether as a result of a technical error or human error or otherwise, such sums will remain our property and will be liable to be deducted from your Account. In the event of an incorrect credit to your Account, you are obliged to notify us immediately by email at Support@BetHog.com upon becoming aware of any such error. If you withdraw funds that do not belong to you before we become aware of such an error, those amounts credited to your Account in error will (without prejudice to other remedies and actions that may be available at law) constitute a debt owed by you to us. We reserve the right to use additional procedures and means to verify your identity when processing withdrawals from your Account. Your withdrawals may be restricted while you have any active Bonus Funds. To maintain the best possible service and security, BetHog may periodically adjust withdrawal limits or schedules for individual accounts.
There are instances where an erroneous deposit or withdrawal cannot be retrieved and BetHog is not liable for reimbursement. Those instances include but are not limited to (i) incorrect wallet addresses submitted, (ii) cryptocurrency sent on unsupported chains, and (iii) XRP sent without an XRP memo.
Wager Thresholds and Limits
We monitor gaming activity by our users on the BetHog on an Account level in real-time, we will set up automated alerts if any wager is abnormally large compared with your prior betting activity. You may be blocked from placing a wager in the event it would put you over certain regulatory dollar thresholds that require additional and full identity verification and documentation checks. Additionally, maximum transaction lifetime thresholds and anti-money laundering triggers are in place to ensure BetHog remains operationally compliant, and that any suspicious behaviors are identified and managed within a real-time environment.
Minimum and maximum wager amounts (each, a “Wager Limit”) may be established, communicated and enforced on the Site and/or within the Services. If a customer attempts to circumvent any Wager Limit, whether through the use of multiple Accounts or through other means, it will constitute a breach of these Terms of Service. In those circumstances, BetHog may take such action as it sees fit, including cancelling the relevant bets or adjusting or withholding winnings.
For the avoidance of doubt, Wager Limits do not impact BetHog’s discretion not to accept a bet or to limit the size of the stake it is willing to accept for a bet, nor does it impact our ability to rely on and enforce these Terms of Service or any other applicable terms.
Bonus Funds
BetHog may from time to time provide you with promotional credits and rewards, including but not limited to bonus(es), free spins, cashback, free bets, and extra money or wager assets (collectively “Bonus Funds”). We reserve the right to modify any promotion concerning Bonus Funds or to discontinue or terminate the Bonus Funds at any time and for any reason. Your eligibility to receive any Bonus Funds is determined by BetHog in its sole discretion. In the event that we believe you are abusing or attempting to abuse a bonus or other promotion or are likely to benefit through abuse or lack of good faith from a policy adopted by BetHog, then BetHog may, at its sole discretion, deny, withhold, or withdraw any bonus or promotion from an Account, or terminate your access to the Site, the Service, and/or lock your Account, either temporarily or permanently.
All Bonus Funds are assigned specific wagering requirements, which can vary, and once complete will convert the Bonus Funds to withdrawable cash. You may view a progress bar for your Wagering Requirements at the bottom of your wallet page.
Bonus Funds are assigned to either casino or sports, and can only be wagered for the assigned product. For Bonus Funds assigned to sports, only wagers with odds of 1.8 or greater are eligible and will count for the Wagering Requirements. The maximum winnings from any Bonus Funds are limited to 4 times the Bonus Funds amount. All Bonus Funds expire within the shorter of any applicable claiming period or thirty (30) days.
10. ERRORS
BetHog will not be liable in the event you try to or obtain an advantage from any errors in respect to bets or wagers on the Site if you were deliberately acting in bad-faith, including where: (i) there is an obvious error in the relevant odds, spreads, handicap, totals, cash-out; (ii) BetHog continues to accept bets or wagers on closed or suspended markets; (iii) BetHog incorrectly calculates or pays a settlement amount, including where a bet is cashed out for the full settlement amount, or a bet is made void incorrectly; (iv) BetHog accepts a bet or wager in excess of the Wager Limit or any other limits that BetHog may set from time to time; or (v) any error occurs in a random number generator or pay tables included, incorporated or used in any game or product.
11. ONGOING MONITORING; PREVENTION OF FRAUD, COLLUSION AND CRIMINAL ACTIVITY
BetHog takes active measures, including monitoring of transactions as necessary to prevent, and to investigate suspected cases of all kinds of fraud, collusion, money laundering activities and/or other forms of criminal activity. BetHog may perform random verification and security checks. You accept that BetHog has the right to demand additional documentation in order to verify your identity and information in the event of any such random check. In addition, active measures are taken to prohibit the use of devices such as robots that may distort the normal game play.
BetHog proactively monitors all wallets and utilizes various identity and anti-money laundering checks to identify and prevent (i) sanctioned activity, and (ii) other criminal and nefarious activities, including those that could be deemed violation of any applicable anti-money laundering laws and regulations. If any wallet is identified to be identified or associated with any such activity, it will be added to a sanctioned wallet repository / blacklist “(Blacklist”). If your wallet is on the Blacklist, it will not be allowed to be linked to your Account, and you, and your Account, and any use of the Site or Services, in BetHog’s sole and absolute discretion, or as we are required by applicable laws or regulations, may be suspended, terminated and/or blocked. If you are found to have placed a bet with funds gained from criminal activity, we may void all wagers in our discretion. Further, we will immediately and automatically remove and permanently ban you, your Account and the wallet from our Site and Services and will report to the proper authorities.
In the event your Account is locked for any reason above, BetHog will unlock your Account only if you provide BetHog with proof that you were not actually involved in such suspected activity. You are required to provide such information within (three) 3 months from the time the Account was locked, or the Account will be permanently terminated.
Notwithstanding anything else contained this Agreement, BetHog is under no obligation and will not disclose the specific reasons for any action taken under this section or in accordance with these Terms or this Agreement, except in its sole and absolute discretion, and in any case only as permissible or advisable under applicable Law
12. BETA SERVICES
From time to time, BetHog may offer new Services (limited preview services or new features to existing Services) in a pre-release version. New Services, new features to existing Services or limited preview services will be known, individually and collectively, as “Beta Services”.
If you elect to use any Beta Services, then your use of the Beta Services is subject to the following terms and conditions: (i) You acknowledge and agree that the Beta Services are pre-release versions and may not work properly; (ii) You acknowledge and agree that your use of the Beta Services may expose you to unusual risks of operational failures; (iii) the Beta Services are provided as-is, so we do not recommend using them in production or mission critical environments; (iv) BetHog reserves the right to modify, change, or discontinue any aspect of the Beta Services at any time; (v) Commercially released versions of the Beta Services may change substantially, and programs that use or run with the Beta Services may not work with the commercially released versions or subsequent releases; (vi) BetHog may limit availability of customer service support time dedicated to support of the Beta Services; (vii) You acknowledge and agree to provide prompt feedback regarding your experience with the Beta Services in a form reasonably requested by us, including information necessary to enable us to duplicate errors or problems you experience; (viii) You acknowledge and agree that BetHog may track your browsing behavior, links clicked, items purchased, your device type, and to collect various data, including analytics, about how you use and interact with our Beta Services; (ix) You acknowledge and agree that all information regarding your use of the Beta Services, including your experience with and opinions regarding the Beta Services, is confidential, and may not be disclosed to a third party or used for any purpose other than providing feedback to BetHog; (x) the Beta Services are provided “as is”, “as available”, and “with all faults”.
You acknowledge and agree that we may use your feedback for any purpose, including product development purposes. At our request you will provide us with comments that we may use publicly for press materials and marketing collateral. Any intellectual property inherent in your feedback or arising from your use of the Beta Services will be owned exclusively by BetHog. To the fullest extent permitted by law, BetHog disclaims any and all warranties, statutory, express or implied, with respect to the Beta Services including, but not limited to, any implied warranties of title, merchantability, fitness for a particular purpose and non-infringement.
In the event Beta Services are available that trade in real money wagers, BetHog will ensure that you receive any true winnings that result, notwithstanding the beta nature of such Services.
13. RESPONSIBLE GAMBLING
We are committed to providing our players with a responsible gaming environment. We comply with all guidelines published to ensure that our Services are properly and transparently monitored to provide player protection. We have implemented the following company policies and tools. The tools are accessible in your Account. 14. COMPLAINTS AND DISPUTE RESOLUTION
Should you wish to register a complaint about the Site or Services, you may email Support@BetHog.com with your request.
15. DORMANT ACCOUNTS
A dormant account is any Account that has been inactive (that is, where the account holder has not logged in to the Account) for a consecutive period of 365 days (a “Dormant Account”). Any funds remaining on deposit and any pending wagers shall be forfeited for Dormant Accounts.
16. PERSONAL DATA
BetHog utilizes the personal data you provide to us in order to provide you with our Services according to our obligations under the Agreement, and to include in accordance with the terms of our Privacy Notice.
17. UNACCEPTABLE USE
You will not:
● use the Site or Services to violate any applicable law or any person’s legal rights;
● interfere with the functioning of the Site or Services in any way;
● use the Site or Services to transmit any virus, Trojan horse, worm, or other software, script or code the effect or intent of which is to permit unauthorized access to, or to alter, disable, encrypt, erase, or otherwise harm, any computer, systems, software or data;
● decrypt, decompile, disassemble or reverse engineer the Site or Services or any software or systems used to provide it;
● access or use any part of the Site or Services that is (expressly or implicitly) not intended for use by you;
● use any non-BetHog automation code in relation to the Site or Services (including any “bot” or “spider”);
● collect or harvest any information from the Site or Services in a bulk or systematic way;
● create derivative or competitive works from the Site or Services;
● link to the Site or Services by way of framing technology or deep links, or otherwise incorporate any portion of the Site or Services into any product or service;
● copy, modify, adapt, reproduce, repurpose, republish, transmit, or distribute any part of the Site or Services;
● rent, lease, assign or transfer any part of the Site, or otherwise permit third parties to access and use the Site or Services; remove, alter, or obscure any proprietary notices on the Site or Services;
● probe, scan, or test the vulnerability of the Site or Services or any network connected to the Site or Services, or breach the security or authentication measures on the Site or Services or any network connected to the Site or Services;
● collect, harvest, reverse look-up, trace, or otherwise seek to obtain any information on any other user of or visitor to the Site or Services;
18. USER CONTENT, FEEDBACK AND SUBMISSIONS
If you upload material, information, comments, postings or other content to the Site ("User Content"), then the User Content will be considered to be non-confidential and non-proprietary, and BetHog will have the right to i) use, copy, distribute and disclose to third parties any User Content for any purpose, and ii) remove, amend or edit any User Content. BetHog has the right to disclose your identity to any third party in the event of a claim that the User Content breaches the third party's rights.
Any ideas, suggestions, or feedback that you provide to BetHog relating to the Site or BetHog’s business will be exclusively owned by BetHog. You agree that: (a) all information you provide on or through a Site (each, a “Submission”) will be true, accurate and complete; (b) you will not impersonate any person or misrepresent any affiliation; (c) BetHog is entitled to rely on each Submission; (d) you will only include the personal information of another individual in a Submission if you have the express permission of that individual or if you are otherwise entitled to do so at law; and (e) you have obtained at your own expense all necessary consents, rights and permissions required to grant to BetHog the license to Submissions described below. By making a Submission, you thereby grant to BetHog an irrevocable, unlimited, sublicensable, transferable, royalty-free, worldwide, perpetual license to use, copy, distribute, modify, make derivative works from, and disclose the information and any other content in the Submission, for any purpose whatsoever including commercial purposes, and you hereby waive all related moral rights or warrant that such rights have been waived by any third-party holder.
However, any personal information that is included in a Submission will only be used and disclosed in accordance with BetHog’s Privacy Statement. BetHog may in its discretion screen, edit, refuse to post, refuse to reply to, and remove any Submissions, in whole or in part, from the Site.
19. GOVERNING LAW & JURISDICTION
These Terms will be governed by the laws of Belize, without reference to any conflict of law rules that might apply the laws of any other jurisdiction.
Except as detailed in the Complaints section of these Terms, you and BetHog each submit consent to the exclusive jurisdiction of the courts of the Belize and all courts competent to hear appeals therefrom to settle any dispute or claim that arises out of or in connection with the Terms or their subject matter or formation (including non-contractual disputes or claims).
Notwithstanding the foregoing, you acknowledge and agree that BetHog is entitled to seek and be awarded (a) an injunction or other appropriate equitable relief from a court of competent jurisdiction anywhere in the world restraining any breach, threatened or actual, of your obligations under any provision of the Terms, and (b) an order from a court of competent jurisdiction anywhere in the world for the purpose of recognizing and enforcing any interim or final judgement, order, injunction, award or other relief granted or provided by the courts of other competent jurisdictions, and you hereby waive any defense you might then have to the granting of such an order.
20. INDEMNITY
You agree to protect, defend, indemnify and hold harmless BetHog and its officers, directors, employees, agents, and third party service providers from and against any and all claims, demands, costs, expenses, losses, liabilities and damages of every kind and nature (including, without limitation, reasonable attorneys’ fees) imposed upon or incurred by BetHog directly or indirectly arising from (i) your use of and access to this Site or the Services found at this Site; (ii) your violation of any provision of this Agreement or the policies or agreements which are incorporated herein; and/or (iii) your violation of any third-party right, including without limitation any intellectual property or other proprietary right. The indemnification obligations under this section will survive any termination or expiration of this Agreement or your use of this Site or the Services found at this Site.
21. CONFIDENTIALITY AND NON-DISPARAGEMENT
Upon registration for an Account, you acknowledge that you may receive communications from BetHog regarding your Account, promotions, support, or otherwise (“Confidential Information”). You agree that you will not use or disclose to any third party any Confidential Information except as authorized by BetHog’s prior written consent. Confidential Information excludes information that: (a) is or becomes generally known to the public through no fault of the recipient; (b) is rightfully known by the recipient at the time of disclosure without a confidentiality obligation; (c) is independently developed by the recipient without use of the disclosing Party's Confidential Information; or (d) the recipient rightfully obtains from a third party without disclosure restrictions.
You agree that you will not, directly or indirectly, take any action or make any statements, written or verbal, including statements on social media sites, that defame, disparage or in any way criticize the personal or business reputation, products, services, practices or conduct of BetHog or any of its parents, subsidiaries, or affiliates, or any of their respective officers, directors, employees, or other contractors. You further agree that you will not engage in any conduct, directly or indirectly, that may be detrimental to BetHog’s mission, reputation, practices, or conduct.
22. DISCLAIMER OF REPRESENTATIONS AND WARRANTIES
YOU SPECIFICALLY ACKNOWLEDGE AND AGREE THAT YOUR USE OF THIS SITE AND THE SERVICES FOUND AT THIS SITE SHALL BE AT YOUR OWN RISK AND THAT THIS SITE AND THE SERVICES FOUND AT THIS SITE ARE PROVIDED “AS IS”, “AS AVAILABLE” AND “WITH ALL FAULTS”. BETHOG, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND ALL THIRD-PARTY SERVICE PROVIDERS DISCLAIM ALL WARRANTIES, STATUTORY, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. IN NO EVENT SHALL BETHOG, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND ALL THIRD PARTY SERVICE PROVIDERS, BE LIABLE TO YOU OR ANY OTHER PERSON OR ENTITY FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING ANY THAT MAY RESULT FROM (I) THE ACCURACY, COMPLETENESS, OR CONTENT OF THIS SITE, (II) THE ACCURACY, COMPLETENESS, OR CONTENT OF ANY SITES LINKED (THROUGH HYPERLINKS, BANNER ADVERTISING OR OTHERWISE) TO THIS SITE, (III) THE SERVICES FOUND AT THIS SITE OR ANY SITES LINKED (THROUGH HYPERLINKS, BANNER ADVERTISING OR OTHERWISE) TO THIS SITE, (IV) PERSONAL INJURY OR PROPERTY DAMAGE OF ANY NATURE WHATSOEVER, (V) THIRD-PARTY CONDUCT OF ANY NATURE WHATSOEVER, (VI) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS AND/OR ANY AND ALL CONTENT, PERSONAL INFORMATION, FINANCIAL INFORMATION OR OTHER INFORMATION AND DATA STORED THEREIN, (VII) ANY INTERRUPTION OR CESSATION OF SERVICES TO OR FROM THIS SITE OR ANY SITES LINKED (THROUGH HYPERLINKS, BANNER ADVERTISING OR OTHERWISE) TO THIS SITE, (VIII) ANY VIRUSES, WORMS, BUGS, TROJAN HORSES, OR THE LIKE, WHICH MAY BE TRANSMITTED TO OR FROM THIS SITE OR ANY SITES LINKED (THROUGH HYPERLINKS, BANNER ADVERTISING OR OTHERWISE) TO THIS SITE, (IX) ANY USER CONTENT OR CONTENT THAT IS DEFAMATORY, HARASSING, ABUSIVE, HARMFUL TO MINORS OR ANY PROTECTED CLASS, PORNOGRAPHIC, “X-RATED”, OBSCENE OR OTHERWISE OBJECTIONABLE, AND/OR (X) ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF YOUR USE OF THIS SITE OR THE SERVICES FOUND AT THIS SITE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL OR EQUITABLE THEORY, AND WHETHER OR NOT BETHOG IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

24. COMPLIANCE WITH LOCAL LAWS
BetHog makes no representation or warranty that the content available on this Site or the Services found at this Site are appropriate in every country or jurisdiction, and access to this Site or the Services found at this Site from countries or jurisdictions where illegal is prohibited. Users who choose to access this Site or the Services found at this Site are responsible for compliance with all local laws, rules and regulations.
IN ADDITION, YOU SPECIFICALLY ACKNOWLEDGE AND AGREE THAT IN NO EVENT SHALL BETHOG’S TOTAL AGGREGATE LIABILITY EXCEED $10,000.00 U.S. DOLLARS. 25. U.S. EXPORT LAWS
This Site and the Services found at this Site are subject to the export laws, restrictions, regulations and administrative acts of the United States Department of Commerce, Department of Treasury Office of Foreign Assets Control (“OFAC”), State Department, and other United States authorities (collectively, “U.S. Export Laws”). Users must not use the Services found at this Site to collect, store or transmit any technical information or data that is controlled under U.S. Export Laws. Users must not export or re-export, or allow the export or re-export of, the Services found at this Site in violation of any U.S. Export Laws. None of the Services found at this Site may be downloaded or otherwise exported or re-exported (i) into (or to a national or resident of) any country with which the United States has embargoed trade; or (ii) to anyone on the U.S. Treasury Department's list of Specially Designated Nationals or the U.S. Commerce Department's Denied Persons List, or any other denied parties lists under U.S. Export Laws. 26. INDEPENDENT COVENANTS; SEVERABILITY; SUCCESSORS; THIRD PARTY BENEFICIARIES
Each covenant and agreement in this Agreement will be construed for all purposes to be a separate and independent covenant or agreement. If a court of competent jurisdiction holds any provision (or portion of a provision) of this Agreement to be illegal, invalid, or otherwise unenforceable, the remaining provisions (or portions of provisions) of this Agreement will not be affected thereby and will be found to be valid and enforceable to the fullest extent permitted by law. This Agreement will be binding upon and inure to the benefit of the parties hereto and their respective heirs, successors and assigns. Nothing in this Agreement will be deemed to confer any third-party rights or benefits.
27. ENGLISH LANGUAGE CONTROLS
This Agreement is executed in the English language. To the extent any translation is provided to you, it is provided for convenience purposes only, and in the event of any conflict between the English and translated version, where permitted by law, the English version will control and prevail. Where the translated version is required to be provided to you and is to be considered binding by law (i) both language versions will have equal validity, (ii) each party acknowledges that it has reviewed both language versions and that they are substantially the same in all material respects, and (iii) in the event of any discrepancy between these two versions, the translated version may prevail, provided that the intent of the Parties has been fully taken into consideration.
28. NOTICES
Each notice under the Agreement must be in writing, and must be delivered to the other party. Each party’s addresses for delivery of notices are as follows, unless otherwise notified by that party:

Appendix 1: Account Creation and Registration Agreement
I. Registration of Account
You must create a valid and verified Account on the Site in order to make use of the Services. You must register personally, and any information provided when registering must be accurate, complete, and must be personal to you (e.g. you must not use another person’s telephone number). We will verify the information provided to us upon registration, and we may in our discretion confirm your address by posting an address verification letter to you at the indicated postal address. If you do not or cannot provide us with the information that we need, we are entitled to restrict your Account in any manner that we reasonably deem appropriate, including preventing you from accessing the Site or Services, and your Account may also ultimately be suspended or permanently closed in accordance with the Terms. We may also suspend or terminate your Account in the event that we discover a breach of the Agreement at any time.
As part of the registration process, we may supply the information you have given us to authorized third parties to confirm your age, identity and registered Account details. They will check any details we disclose to them against any databases (public or private) to which they have access and will keep a record of that check. You agree that we may process such information in connection with your registration. Third party vendors we utilize on our behalf for these purposes will be identified on the Site, are subject to the terms of our Privacy Notice, and may be subject to change from time to time. You may only open one Account with BetHog. If you open more than one Account, each such additional Account will be classified as a "Duplicate Account".
If we discover that you hold one or more Duplicate Accounts, we will (in respect of each Duplicate Account) (i) close the Duplicate Account(s) or the original Account (as applicable), leaving you with only one Account (unless we have reason – for example if you have deliberately or fraudulently opened more than one active Account – to close all of your Accounts); (ii) treat any promotional credits, bonus(es) or otherwise, and all winnings obtained using the Duplicate Account as void; and (iii) void all future Bets made on the Duplicate Account.
Account registration requires an email address as your login. At time of registration, you will be prompted to create a password and a unique verification link will be sent to the email address associated with your account. You must keep your password secret and confidential and you agree that you are solely responsible for all use of the Company’s Services through your Account. You shall not allow any other person or third party, including, without limitation, any minor, to use or reuse your Account, accept any prize, or participate in the Services. Any unauthorized use of your Account shall be your sole responsibility and shall be deemed as your use. Any liability originating from such use shall be attributed to you. If at any time you have reason to believe or knowledge of unauthorized access to your email that is associated with your account that could result in unauthorized access of and/or use of your Account, it is your responsibility and obligation to notify BetHog immediately by contacting Support@BetHog.com.
We reserve the right to refuse to register a player for any reason at any time without providing justification.
II. Account Verification, Restrictions and Requirements
As a licensed gambling operator and in compliance with our legal and regulatory obligations we are required to conduct a number of checks during the whole time that you have an Account with us. In order to meet our regulatory obligations, we may ask that you provide personal details and/or documentation relating to your identity and/or financial circumstances. By creating and Account in accordance with the terms of the Agreement, you authorize BetHog to conduct any and all such identification, credit and other verification checks from time to time that we may require and/or are required by applicable laws and regulations (including without limitation for the purpose of complying with anti-money laundering laws and regulations) and/or by the relevant regulatory authorities for use of the Site and the Services. You accept that all transactions may be checked to prevent money laundering and that any transactions made by you which we deem to be suspicious may be reported to the appropriate authorities.
In order to register an Account, you promise and confirm to us that you:
○ Are at least 18 years of age (underage gambling is a criminal offense in certain jurisdictions);
○ Will provide accurate registration information, including without limitation your correct date of birth and your country of residence, together with valid identification proving the same, your country of residence, your current address, email address and personal telephone number. You further agree to promptly inform us of any changes in such details;
○ Are opening an Account solely for your own personal use, and you are not acting and will never act on behalf of any third party in connection with your Account;
○ Are not located in a jurisdiction where the use of the Services is prohibited;
○ Will not attempt to sell or otherwise transfer the benefit of your Account to any third party and nor will you acquire or attempt to acquire an Account which has been opened in the name of a third party;
○ Will comply with your own local, national, federal, state or other laws concerning betting and gaming prior to opening an Account, placing any bets, or using our Services;
○ Are not prohibited for any reason from betting with us or any member of the BetHog group of companies, or from using the Services or any of the services of any member of the BetHog group of companies;
○ Are not currently subject to a self-exclusion from any other BetHog provided account and you have not signed up to a national self-exclusion register which excludes you from gambling;
○ Accept that by using the Services, there is a risk that you may lose money; and
○ Will, following a request from us (which may be made at any time before or after you open an Account), promptly provide any documentation or information which we request in order to evidence your identity, age, address, country of birth or authorization to use a particular credit or debit card (and you agree that we may perform checks in order to verify any such documentation or information).
Provided that we have been correctly supplied with the Account information requested, we are entitled to assume that any activity occurring under/using your correct Account credentials is undertaken or authorized by you.
III. Account Verification and Due Diligence
The following information must be provided during the Account registration process (additional information that may be required based on jurisdiction is set forth in the Country Specific Terms):
○ date of birth;
○ first and last name;
○ full residential address;
○ valid email address; and
○ acknowledgment that you are at least 18 years of age, all information provided is accurate, and that you agree to adhere and be bound by our Terms of Service.
Provided that we have been correctly supplied with the Account information requested, we are entitled to assume that any activity occurring under/using your correct Account credentials is undertaken or authorized by you.
Appendix 2: Prohibited Jurisdictions
The list below represents jurisdictions where BetHog does not offer or market our intended services. This list is subject to frequent updates, taking into consideration at all times (1) our own analysis in light of applicable laws, regulations and currently existing risks, (2) Lists and Recommendations by FATF (as published by the Department of Home Affairs as Lists A, B and C in accordance with the Anti-Money Laundering and Countering the Financing of Terrorism Code 2019), and (3) OFAC Sanctions List. Note, this list may not reflect all jurisdictions that BetHog has, purely for business reasons, including those due to licensing requirements or restrictions, determined not to market to or do business in.
